End-user licence agreement (EULA)

Terms governing the purchase, activation and use of LoadMosaic.

1. Parties and acceptance

This agreement is between Rafael Guerrero Chueca, as LoadMosaic licensor, and the person or organisation acquiring or using the licence. The applicable product, price and order are those confirmed at checkout. Installation, activation or use requires acceptance of the version of these terms presented for the purchase. Mandatory consumer rights prevail.

2. Licence granted

After valid payment, the licensor grants a non-exclusive, non-transferable licence to install and use the purchased LoadMosaic major version for the licensee’s internal personal or professional activities. The licence is not a sale or assignment of the software or source code.

The payment is one-time, not a subscription. “Perpetual” means that the right to use the purchased major version has no contractual expiry date or recurring fee, subject to lawful termination for material breach. After a valid activation, the application can continue for up to 365 consecutive days without a successful online validation. If that period is completed, it automatically enters permanent offline mode for the purchased major version. Before permanent offline mode begins, an explicit response that the licence is invalid, revoked or refunded may disable it.

3. Devices and licensee

One licence may be activated on up to two computers used by the same individual licensee or, for an organisational purchase, by that organisation for its internal activity. A device may be deactivated and replaced through the available licence-management process. Activation capacity may not be pooled, rented or shared with unrelated people or entities.

4. Permitted and prohibited acts

  • You may make a reasonable backup copy and use generated reports and your own data in your activities.
  • You may not resell, sublicense, rent, lend, publish or transfer the licence to another person or entity without prior written permission.
  • You may not disclose or share a licence key, circumvent activation or Trial controls, or use one licence beyond its device allowance.
  • You may not reverse engineer, decompile or modify the software except to the limited extent that mandatory law expressly permits and only after requesting necessary interoperability information where required.
  • You may not use the software or website unlawfully or to infringe third-party rights.

5. User data and privacy

The licensee retains ownership and responsibility for its boxes, pallets, distributions, configurations and exported files. Ordinary logistics calculations run locally. Licence and support processing is described in the Privacy policy. The licensee must protect its Windows account, files and licence key.

6. Versions and updates

The purchase includes updates released within the 1.x major version. They may contain corrections, compatible improvements and technical changes. A future major version, such as 2.x, may be offered separately and may require a new payment or licence. No future feature or release date is promised.

For consumers, updates—including security updates—needed to maintain legal conformity will be supplied for the period they may reasonably expect under mandatory law. That obligation prevails where applicable.

7. Support and external services

Email support is available at [email protected] according to availability, without a guaranteed response time or service-level agreement. Purchase and licensing depend in part on Lemon Squeezy and Cloudflare services. Planned maintenance, security measures or failures outside reasonable control may temporarily affect them.

8. Loading results and safety

LoadMosaic is a decision-support tool. Before carrying out any loading, transport or handling operation, the user must verify dimensions, weights, centre of mass, stability, resistance, stacking, securing, compatibility, equipment limits and all technical, labour, transport and road-safety rules with competent personnel where necessary. The software does not replace professional judgement, testing or applicable regulations.

9. Conformity and liability

Reasonable efforts are made to match the published description, but software cannot be guaranteed to be uninterrupted or entirely error-free. Consumers retain all mandatory conformity remedies. For professional users, exclusions apply only to the fullest lawful extent and never to fraud, gross negligence, personal injury or liability that cannot be limited.

To the extent legally permitted, the licensor is not liable for unverified decisions, incorrect input, unauthorised modifications, prohibited use or systems outside reasonable control. This does not exclude statutory refunds or remedies.

10. Termination, law and disputes

The licence may be terminated for a material breach, after a reasonable opportunity to remedy a remediable breach. On valid termination, use must cease and copies must be removed. Consumer rights and ownership of user files are unaffected.

Spanish law applies without depriving consumers of mandatory protection in their country. Courts are determined by mandatory rules. The parties may first contact [email protected] to try to resolve an issue without restricting legal deadlines or remedies.
